Dunyatek Software Terms of Use

1. Scope of Services and Definitions

 

Our Services are platforms that enable users to securely create, organize, store, and manage their personal information, documents, notes, and other digital content. The Services include:

 

• iOS and Android mobile applications

• Web-based management dashboards

• Third-party API integrations (OneNote, Google Workspace, Facebook Graph API, Apple HealthKit, etc.)

• Cloud-based synchronization and backup services

2. User Account and Registration Terms

 

2.1. Registration

• Accurate Information: Your first name, last name, email address, and other details provided during registration must be accurate, current, and complete. Providing false information is prohibited.

• Age Requirement: You must be at least 13 years old to use our Services. Accounts belonging to users under 13 will be suspended and deleted immediately.

• Account Security: You are solely responsible for keeping your password confidential, not sharing it with third parties, and choosing a strong password.

• Non-Transferable Account: You may not transfer, sell, or attempt to transfer your account to any other person.

 

2.2. Sign-In Methods

 

The following methods may be available for accessing our Services:

 

• Email and Password: Direct registration and sign-in

• Google Sign-In: OAuth 2.0-based social sign-in

• Facebook Login: Sign-in based on the Facebook Graph API

• Apple Sign-In: Apple authentication for iOS devices

 

Important: When you use a social media sign-in method, the respective platform's own terms of use and privacy policy apply.

3. Data Collected and Purposes of Use

We may collect the following data in order to provide the Services:

3.1. General User Information (All Applications)

 

• Identity information: First name, last name, email address, profile photo

• Device information: Device model, operating system, unique device identifier (UUID), IP address

• App usage data: Sign-in times, features used, error logs (crash logs)

• Location data: Only if permitted in the app and where required by the service (with user consent)

3.2. Application-Specific Data

The data we collect is processed for the following purposes:

 

• Providing the core functions of the Service (note creation, lab test analysis, synchronization)

• Verifying user identity and ensuring security

• Delivering a personalized user experience (preferences, past activity)

• Monitoring and improving app performance (analytics, crash reporting)

• Fulfilling legal obligations (data retention, judicial requests)

• Communicating with users (updates, notifications, support)

4. Permissions and Access

 

Our applications may access the following permissions only when necessary and with user consent:

 

• Camera: To scan documents in BiyoAsistan or add photos in Notum

• Photo Library: To upload existing documents or images

• Storage: For local backup and caching

• Internet: For cloud synchronization and updates

• Notifications: For user reminders and updates

• Apple HealthKit (iOS): BiyoAsistan only, and only if the user grants permission

 

Important: No permission is mandatory for the service to function. No data is accessed or collected without the user's permission.

5. Third-Party Services and Data Sharing

 

We may use the following trusted third-party services to provide the Services. Your data may be subject to these services' own privacy policies:

 

• Firebase (Google): Authentication, database, storage, analytics, Crashlytics. Terms: firebase.google.com/terms

• Facebook Login: Social media authentication. Terms: facebook.com/terms

• Google Sign-In: OAuth-based sign-in. Terms: policies.google.com/terms

• Apple Sign-In: iOS authentication. Terms: apple.com/legal

• Microsoft Graph API (OneNote): Note import. Terms: docs.microsoft.com/legal

 

Sale of Data: We never sell or rent user data to third parties. Data is shared only to the minimum extent necessary to provide the Service.

6. Data Security and Protection Measures

 

The security of your user data is our highest priority:

 

• Encryption: All data is encrypted in transit (TLS 1.3) and at rest (AES-256).

• Firebase Security Rules: Database access is restricted to authorized users only.

• Regular Audits: We commission third-party audits to identify security vulnerabilities.

• Employee Access: Our employees receive data privacy training, and their access is logged.

• User Control: Only you and the people you authorize can access your data.

 

7. User Rights (GDPR & KVKK Compliant)

 

Under the European Union General Data Protection Regulation (GDPR) and KVKK (Turkish Personal Data Protection Law No. 6698), you have the following rights:

 

 

• Right of Access: You may view and download all of the personal data in your account.

 

• Right to Rectification: You may update inaccurate or incomplete data.

 

• Right to Erasure (Right to be Forgotten): You may permanently delete your account and all of your data.

 

• Right to Data Portability: You may export your data in JSON format.

 

• Right to Object: You may object to data processing and request that processing be stopped.

 

• Right to Restriction: You may request that data processing be temporarily suspended.

 

8. Account and Data Deletion

 

To permanently delete your account and all associated data, you may use any of the following methods:

 

 

 

• Your request will be processed within 7 business days at the latest.

 

• Deletion is irreversible.

 

• Except where required by law, no data is retained in backups.

 

9. Children's Privacy

 

Our Services are not directed to children under the age of 13. We do not knowingly collect personal data from users under 13. If you become aware that data belonging to a child under 13 is in our system, please contact us immediately at [email protected]. Such cases are reviewed within 24 hours and appropriate action is taken.

10. Changes and Updates

 

We may update these Terms of Use from time to time. For material changes, we will:

 

 

• Send an in-app notification

• Notify you by email (at your registered email address)

• Display the effective date and version number at the top of the page

 

Your continued use of the Services after any changes constitutes your acceptance of the revised terms. If you do not accept the terms, please stop using the Services and delete your account.

11. Limitation of Liability

 

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." Dunyatek:

 

• Does **not** guarantee uninterrupted or error-free service.

• Is not liable for data loss (users are responsible for maintaining their own backups).

• Is not liable for any direct, indirect, incidental, or punitive damages.

• Is not liable for third-party service outages (Firebase, Facebook).

• Is not liable in cases of force majeure (natural disasters, war, attacks).

 

The limits of legal liability are governed by the laws of the Republic of Türkiye and Consumer Protection Law No. 6502.

12. Intellectual Property Rights

 

• Application Code and Design: All source code, interface designs, logos, and brand identity of Dunyatek applications are the property of our Company. Copyright is governed by Law No. 5846 on Intellectual and Artistic Works.

• User Content: You retain the intellectual property rights to your notes, lab results, and any other content you upload. Dunyatek receives a limited, non-exclusive, non-transferable license to use such content solely to provide the Service.

• License Restrictions: Reverse engineering, copying, or redistributing the application, or using it for anything other than non-commercial purposes, is strictly prohibited.

 

13. Refunds and Subscription Terms

 

Purchase and subscription options may be available for premium features offered in our applications:

 

 

• Pricing: All prices are in Turkish Lira (TL) and include VAT.

• Payment: Payments are processed through the Google Play Store or Apple App Store. Dunyatek does not access your payment data.

• Subscription Renewal: Subscriptions renew automatically. To cancel, you can manage your subscription from your store account.

• Refunds: Refund requests are subject to Google/Apple policies. Dunyatek cannot issue refunds outside of the app stores.

• Price Changes: Notice of any price change will be given at least 30 days in advance.

 

14. Dispute Resolution and Complaints

 

In the event of any issue, complaint, or dispute, please follow the steps below:

1. Consumer Arbitration Committee: If no resolution is reached, you may apply to the Consumer Arbitration Committee (Tüketici Hakem Heyeti) under the Ministry of Trade of the Republic of Türkiye.

1. Jurisdiction: The Courts and Enforcement Offices of Istanbul (Çağlayan) shall have jurisdiction over any disputes.

 

15. Entire Agreement and Severability

 

These Terms of Use constitute the entire agreement between Dunyatek and the user. The invalidity of any provision shall not affect the validity of the remaining provisions. Our Company's failure to exercise any right under these terms shall not constitute a waiver of that right.
